This document defines the conditions for the use of the website www.villalago.ro and any web page (website, landing page, etc.) owned, managed, or operated under the umbrella of the company WE EAT 3 S.R.L. (the "Website") by its users, including guests of the VILLA LAGO restaurant.
Use of the Website implies explicit, full, and unconditional acceptance of these Terms and Conditions, as set forth below ("Terms and Conditions"). Thus, by using the Website, you confirm that you have read and accepted the Terms and Conditions as presented below and that you possess the necessary age, capacity, and standing to access and use the Website in accordance with applicable law. Failure to accept the Terms and Conditions obliges the user to cease accessing and using the Website and renders it impossible to obtain the information available thereon. Access to and use of the Website are therefore subject to the Terms and Conditions as well as all applicable legal regulations.

The VILLA LAGO restaurant is managed by the company WE EAT 3 S.R.L., which also owns the Website, with the following identification details:

III. INTELLECTUAL PROPERTY, WEBSITE USE, AND LIMITATION OF LIABILITY

Users acknowledge that they understand that the intellectual property rights regarding the Website and its content—including, but not limited to, photographs, images, web graphics, symbols, text, software, scripts, and trademarks—belong to VILLA LAGO and are protected by intellectual property legislation, including Law no. 8/1996 on copyright and related rights, as subsequently amended and supplemented.
Consequently, the use of the Website and/or its content, in whole or in part, is permitted only with the consent of VILLA LAGO and under the conditions set forth below.
a) USE OF THE WEBSITE AND ITS CONTENT
As a user, you must comply with the Terms and Conditions as well as all policies made available on the Website.
The Website and its content may be used solely for personal purposes and strictly in accordance with VILLA LAGO’s instructions. Any attempt to exploit the Website for commercial purposes or in a manner contrary to VILLA LAGO’s interests is prohibited.
Consequently, the use of the Website—or its content, in whole or in part—in an improper manner is not permitted; this includes, without limitation: attempting to influence or access the Website other than through the interface and in accordance with the instructions provided by VILLA LAGO; attempting to modify images or information displayed on the Website; attempting to manipulate Website functionalities; attempting to upload viruses or similar programs; posting or transmitting content that is illegal, discriminatory, racist, false, misleading, threatening, offensive, defamatory, obscene, or otherwise harmful; using automated tools or bots to access and index Website content; and attempting to provide promotional content.
A single download of specific information onto a single device for personal, non-commercial use is permitted, provided that all intellectual property rights are respected. No other use arising from accessing and/or using the Website is permitted, including, but not limited to, the capturing, copying, uploading, displaying, publishing, archiving, reproducing, extracting, transmitting, distributing, modifying, or creating of derivative works—in any form, in whole or in part—of the Website and/or its content (including materials presented on it and/or other elements included therein) by any person without obtaining VILLA LAGO’s prior written consent. Assisting or collaborating with any persons in connection with any of the aforementioned activities is also prohibited.
Upon the user's express request and subject to a prior, express written agreement, VILLA LAGO may grant the user the right to use specific Website content—in a manner expressly accepted—for a purpose other than that permitted by these Terms and Conditions. Such an agreement applies strictly to the defined content, for the duration specified in the agreement, and to the person(s) authorized to use it.
The use of any third-party name, trademark, or logo on the Website does not constitute an advertisement for the respective entity, and said name, trademark, and/or logo are not the property of VILLA LAGO.
Any content posted or published by users on the Website—such as, but not limited to, questions, suggestions, or comments—shall not be considered confidential and/or protected by the users' intellectual property rights. VILLA LAGO bears no liability for such content. Furthermore, VILLA LAGO shall have the right to use said content without any limitation regarding time, geography, or any other nature, and without the obligation to pay any amount on any grounds for such use. However, to the extent that content posted or published by users on the Website is protected by intellectual property rights, users hereby grant VILLA LAGO—through these Terms and Conditions—an irrevocable and non-exclusive right to use said content (including reproducing, distributing, publicly communicating, retransmitting, and creating derivative works based thereon) without any limitation regarding time, geography, purpose, or any other nature, and without any obligation for VILLA LAGO to pay any amount on any grounds for such use, nor any obligation for VILLA LAGO to actually exercise said rights. Users declare and warrant that any content posted or published by them on the Website belongs to them and/or that they have the right to grant VILLA LAGO the rights mentioned in these Terms and Conditions and do not infringe upon the rights of any third party regarding said content; furthermore, users undertake to maintain such rights for an indefinite period.
Non-compliance with these Terms ...and Conditions and/or any policy made available on the Website—including the use of the Website or its content without VILLA LAGO’s consent—is punishable under applicable law. The legal holders of the infringed rights, including rights regarding images and information presented on the Website, have the right to seek redress through competent courts to penalize such infringements and to take any other legal action to protect their rights and recover damages caused by such infringement.
Furthermore, VILLA LAGO may suspend or terminate access to the Website and/or the provision of services to users who fail to comply with the Terms and Conditions and/or VILLA LAGO’s policies, or where VILLA LAGO is investigating suspected inappropriate conduct, or if activities are identified that are suspicious in nature—including, without limitation, those described in these Terms and Conditions—or in the event of any other violation of applicable law. VILLA LAGO also reserves the right to remove from the Website any content posted by a user or third party that violates the provisions of these Terms and Conditions, infringes upon the rights of third parties, or breaches applicable legal provisions, without any obligation to notify the respective users or third parties. To this end, VILLA LAGO may implement any filters it deems necessary to prevent such violations, behaviors, and activities.
Please report to marketing@villalago.ro any suspected infringement of VILLA LAGO’s intellectual property rights observed on the Website, as well as any apparently unlawful activities carried out by any other user or third party and any apparently unlawful information provided by any user or third party. VILLA LAGO will review any notification received in this regard—provided it includes a clear description and details concerning the alleged infringement or reported information and its location, as well as a sufficiently substantiated explanation of the grounds for the report—and will take necessary measures as appropriate.
b) LIMITATION OF LIABILITY
VILLA LAGO makes every reasonable effort to ensure that the information provided on the Website is correct, complete, accurate, and up-to-date; however, to the maximum extent permitted by law, it assumes no liability or responsibility for omissions or errors in the content. In such instances, users should notify VILLA LAGO at marketing@villalago.ro, and the company will endeavor to remedy the issues within reasonable limits.
The culinary dishes displayed on the Website are photographed and presented with the aim of reflecting the offered products as accurately as possible. However, there may be minor differences regarding the presentation, garnish, or final appearance of the dishes, resulting from the specific nature of the preparation and serving process.
VILLA LAGO makes every reasonable effort to ensure that the descriptions, images, and information displayed on the Website are accurate, complete, and up-to-date.
Except where otherwise provided in these Terms and Conditions and to the maximum extent permitted by law, we do not declare or guarantee:
• the real-time updating of all information available on the Website; product images and descriptions are intended to reflect the offered products as faithfully as possible, yet minor differences in presentation or appearance may occur due to the preparation and serving process;
• the uninterrupted availability of the Website or its operation without errors, delays, connection failures, interruptions, or other similar disruptive factors;
• the compatibility of the Website with the operating system, browser, or software used by users.
Accessing, using, and browsing the Website is done at the users' own risk. Thus, by accessing and/or using this Website, users agree that, to the maximum extent permitted by law, VILLA LAGO shall not be held liable for any damages arising from accessing, using, or browsing the Website—including damages resulting from a link to which the Website refers (even if VILLA LAGO had been informed of such potential damages), from the use of the Website by other users, or from the inability to access the Website; Such damage may include, by way of example but without limitation, malfunctions, viruses, or the effects of cyberattacks or attacks using other harmful digital tools that may occur on or affect users' computers, phones, or other work equipment, the programs or applications installed on them, data, other materials, or any platform used to access the Website.

IV. USE OF THE ONLINE ORDERING PLATFORM FOR RESTAURANT AND BAR PRODUCTS ("Dine IN") ON THE PREMISES OF VILLA LAGO RESTAURANT AND ONLINE RESERVATIONS

Food and beverage orders on the premises are placed by scanning a QR code provided at the VILLA LAGO restaurant.
VILLA LAGO restaurant provides guests with the Dine In App, allowing them to order items from the restaurant menu for consumption on the premises.
For clarity, please note that the Website is used exclusively for making reservations at the VILLA LAGO restaurant; orders for menu items cannot be placed via the Website. Orders may be placed using the Dine In App.
Reservations at the VILLA LAGO restaurant can be made using the form available on the Website. Reservations do not require any payment from users and must be made at least 24 hours prior to the scheduled date and time, subject to availability.
Reservations may be modified up to 12 hours before the scheduled date and time, subject to availability.
Reservations may be cancelled at least 24 hours prior to the scheduled date and time at no cost. In the event of cancellations that do not comply with the aforementioned conditions, VILLA LAGO reserves the right to refuse future reservations for the users in question. Users do not have an additional right of withdrawal beyond the right to cancel orders as set out above.
VILLA LAGO Restaurant may cancel reservations if any of the data or information provided by the user is incomplete or incorrect.
The user is responsible for the accuracy and currency of the data provided for account registration and/or order placement within the Dine In Application, as well as for the accuracy and currency of the data provided in the reservation form.

V. PROMOTIONS AND SPECIAL OFFERS

VILLA LAGO independently establishes the rules for the promotions and special offers it runs. Active promotions are communicated to guests via the website, the Dine In app, email, newsletters, or other promotional channels. Only participants who strictly adhere to the communicated rules are eligible to benefit from these promotions.

VI. PROTECTION OF PERSONAL DATA (GDPR)

The website processes users' personal data in accordance with applicable legislation, including Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR). Data may be collected, among other ways, via online forms for purposes such as making reservations, subscribing to the newsletter, or sending messages. Users have the following rights:
• the right of access to data;

VII. AMENDMENTS

VILLA LAGO reserves the right to modify, update, or discontinue the operation of the Website and to modify, update, or delete any content published on the Website at any time, without prior notice.
Furthermore, VILLA LAGO reserves the right to modify and update these Terms and Conditions from time to time. Users will be notified of any modifications and updates in advance via a notification sent within a reasonable timeframe. However, users are advised to periodically check the Terms and Conditions and the Website content to stay informed about any changes and updates and to ensure compliance with VILLA LAGO’s Terms and Conditions and policies.

VIII. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by Romanian law, and any dispute regarding them shall be resolved by the competent courts. However, any dispute between VILLA LAGO and users—including guests of the VILLA LAGO restaurant—may be resolved through amicable conciliation. To this end, users may contact VILLA LAGO at marketing@villalago.ro. Contacting VILLA LAGO to resolve a dispute does not affect the users' right to file claims and/or complaints through any legal means available to them, including via alternative dispute resolution bodies legally authorized to provide such services—such as the National Authority for Consumer Protection’s SAL platform (available at https://anpc.ro/ce-este-sal/) and the European Commission’s ODR platform (available at https://ec.europa.eu/consumers/odr).

IX. FINAL PROVISIONS

In the event that one or more clauses of these Terms and Conditions are declared, in whole or in part, null, voidable, invalid, or unenforceable, for any reason, the clause declared null, invalid, or unenforceable shall not affect the validity and enforceability of the remaining clauses, which shall continue to apply accordingly.
